Sales conditions

Buyer's premium is 25%.

Sales via Drouot and Interenchères are subject to a 3% surcharge, while those via Invaluable and Auction.fr are subject to a 5% surcharge.

If the purchase amount exceeds €20,000, the higher amount will be charged at 20%.

Objects created by artists subject to the following law will incur an additional 4% statutory surcharge.

1. Nature of the service: Stanley's Auction is mandated by the consignor to offer an object for sale in a condition that will have been verified by the buyer at the time of the exhibition. Stanley's Auction does not sell but rather connects the seller and the buyer, without incurring any liability whatsoever for the nature, origin, or condition of the object.

2. Capacity: The consignor warrants that he or she is the capable and legal owner of the object or the fully authorized agent for its sale. In the event of withdrawal before the sale, regardless of the reason, the consignor is required to reimburse Stanley's Auction for the seller's premium applied to the high estimate. No withdrawals will be accepted from the first day of exhibition preceding the sale. Any forced withdrawal by public authorities would lead to prosecution and damages against the defaulting consignor, in addition to the seller's premium on the high estimate before the sale and on the hammer price after the sale.

3. The Object: The consignor declares that the object deposited is available, legal, legally held, and, in the case of a non-European object, that it was acquired in its country of origin before 1970 and/or in accordance with all applicable regulations and requirements. Any failure to provide or incorrect information on these points would be the sole responsibility of the consignor, who affirms by signing this contract that Stanley's Auction has duly inquired about the provenance and origin of the object and has received responses confirming its availability and legality. Stanley's Auction is authorized to disclose this information to the authorities and to the prospective buyer. In the event of falsehood, Stanley's Auction will be released from all liability and reserves the right to notify the authorities to address any detected fraud. Furthermore, Stanley's Auction reserves the right to withdraw from sale any item whose legality is questioned and, if necessary, to file a legal complaint against the false depositor.

4. Intellectual Property: The depositor waives any intellectual property restrictions on the item and authorizes any use of the illustrations or photographs of the item before, during, and after the sale.

5. Reserve Value: When depositing a lot, the depositor may specify a reserve value, i.e., a minimum hammer price below which the lot cannot be sold. This reserve will be indicated alongside the estimates on the deposit slip. However, Stanley’s Auction has the right to sell the goods, at its own discretion, for an amount lower than the reserve value but equal to or higher than the net amount payable. In this case, the amount payable to the seller will be calculated on the basis of the sale proceeds that he would have obtained if the goods had been sold at the reserve value. There is no reserve below €300 unless this clause is crossed out by hand with the initials of a Stanley’s Auction expert. If the reserve value has not been reached at the auction, Stanley’s Auction then has the authorization to negotiate for sale by private treaty at the limit provided for and to include this lot, as long as it remains in stock, again in a subsequent sale but without reserve unless the owner takes back the unsold item within one month following the sale and pays €10 insurance and administration fees.

6. Payment, Commission, and Bidding Failure: In the event of a sale, the hammer price, less the commission set by the expert or Stanley's Auction, will be paid to the depositor upon receipt of payment by the buyer. The amount may be paid in cash for amounts below €3,000 or by bank transfer to the BELFIUS account BE76 0689 0795 5995. Stanley's Auction is not required to pay for a lot not paid for by the buyer, who will then be declared a bidder after 10 days from the sale. In the latter case: - either the depositor decides to sue the bidder on their own to force them to complete the purchase; - or the depositor requests Stanley's Auction to put the item back up for sale by private treaty or at a future auction. These instructions should be confirmed by email or letter. The difference between the future sale and the original sale remains due by the unsuspecting bidder. However, Stanley's Auction is not responsible for recovering these amounts; the sale is canceled, and the item is returned to the depositor free of charge. Stanley's Auction acts solely as an intermediary for the seller and the buyer and is therefore not liable in the event of any waiver by either party.

7. Description and Valuation: The description of the item is solely an opinion provided for guidance purposes and Stanley's Auction SPRL shall not be held liable. Stanley's Auction shall not be held liable for any errors or omissions revealed before, during, or after the sale, whose sole mission is to attempt to connect a seller and a buyer, not to definitively appraise the item. The depositor declares that Stanley's Auction is free to use its full discretion in describing the item. The item's valuation is solely an opinion, and Stanley's Auction cannot be held liable for any damages resulting from the sale. The Consignor declares that he or she wishes to offer his or her item for sale based on these valuations, which he or she approves, believing them to be the most appropriate for achieving the actual sale of the item. Any subsequent sale results for the same item at any auction house, fair, or gallery cannot give rise to any claims against Stanley's Auction SPRL. The photos are non-contractual.

8. Freedom of Auction: Stanley's Auction reserves the right not to auction one or more lots, to postpone lots to subsequent auctions, or to split or combine lots.

9. Bidding: The auctioneer may open the bidding on each lot by making a bid on behalf of the seller. Furthermore, the auctioneer has the right to make successive bids on behalf of the seller, or bids in response to other bids on behalf of the seller, until the reserve value is reached.

10. The bidder forms their own opinion regarding the authenticity, condition, or any other parameters of the item purchased. Stanley's appraisal is provided for informational purposes only, allowing the bidder to form their own appraisal in full knowledge of the facts before bidding. Bidders bid an amount they are financially capable of paying, including fees, and do so with full knowledge of the facts, whether they are present at the sale, by written order, by commission, by telephone, or by any other means of communication. Bidders purchasing online, by telephone, or by submitting a written absentee bid are deemed to have been able to examine the lot(s) and may not challenge the purchase if the item(s) are found to be non-compliant. Additional photos and details may be requested prior to any purchase. The bidder is deemed to accept the General Conditions by registering and participating in the sale.

11. In the event of a dispute immediately following the sale due to an unobserved third-party bid, Stanley's Auction has the right to resell the item. To this end, only the hammer strike confirmed by "sold" will mark the sale.

12. Once the lot has been sold, the auction winner assumes all risks related to the item. However, complete transfer of ownership will take place upon receipt of payment for the item sold.

13. The amount payable by the buyer will be the hammer price plus 25% (a 3% surcharge for sales via Drouot and a 5% surcharge via Invaluable and Auction.fr). If the item is subject to resale rights, an additional 4% of the hammer price will be charged.

14. The item must be paid for and collected within one week of the sale. Thereafter, a storage fee of €10 per day of storage will be charged, unless Stanley Auction sprl grants a later date. Risks are assumed by the buyer upon sale.

15. As Stanley Auction sprl is subject to the special margin regime, there is no VAT.

16. Any dispute shall be settled before the courts of Brussels.
